1. Acceptance of Terms

Welcome to WatchMo! By downloading, installing, or using the WatchMo mobile application ("App") or any related services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use WatchMo.

These Terms constitute a legal agreement between you and WatchMo ("we," "us," or "our"). We may update these Terms from time to time, and your continued use of the App after such changes constitutes acceptance of the new Terms.

2. Description of Service

WatchMo is a social sports prediction platform that allows users to:

• Create prediction competitions ("WatchMos") for college basketball games
• Invite friends to join using invite codes
• Submit predictions about player and team statistics
• View live leaderboards and results
• Share results on social media

3. Eligibility

To use WatchMo, you must:

• Be able to form a binding contract with WatchMo
• Not be prohibited from using the App under applicable laws
• Have a valid email address

Users under 13 years of age may use WatchMo with parental or guardian consent and supervision. Parents or guardians who allow minors to use WatchMo are responsible for their activity and compliance with these Terms.

4. User Accounts

4.1 Account Creation

To access most features, you must create an account by providing:

• A valid email address
• A password
• A display name

4.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password
• All activities that occur under your account
• Notifying us immediately of any unauthorized use

We are not liable for any loss or damage arising from your failure to protect your account credentials.

4.3 Account Termination

You may delete your account at any time through the App's feedback feature. We reserve the right to suspend or terminate accounts that violate these Terms.

5. User Conduct

5.1 Acceptable Use

You agree to use WatchMo only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App for any illegal purpose
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Post offensive, obscene, or inappropriate content
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the App's functionality
• Use automated scripts, bots, or scrapers
• Circumvent any security measures
• Use the App for commercial purposes without permission

5.2 User Content

You are responsible for any content you create, including:

• WatchMo names
• Custom questions
• Display names
• Feature requests and feedback

By posting content, you grant WatchMo a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content in connection with the Service.

6. Not a Gambling Service

WatchMo is purely for entertainment and social competition among friends. If you have concerns about gambling addiction, please seek help from resources like the National Council on Problem Gambling (1-800-522-4700).

7. Intellectual Property

7.1 Our Property

WatchMo and its original content, features, and functionality are owned by WatchMo and are protected by copyright, trademark, and other intellectual property laws. This includes:

• The WatchMo name and logo
• App design and user interface
• Software and source code
• Documentation and materials

7.2 Third-Party Content

Game statistics and sports data are provided by ESPN and other third-party sources. Team names, logos, and player information are the property of their respective owners and are used for informational purposes only.

8. Disclaimers

8.1 Service "As Is"

WatchMo is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not guarantee that:

• The App will be uninterrupted or error-free
• Results will be accurate or reliable
• The quality will meet your expectations
• Errors will be corrected

8.2 Sports Data

We rely on third-party sources (ESPN) for sports statistics. While we strive for accuracy, we do not guarantee the accuracy, completeness, or timeliness of any sports data displayed in the App.

8.3 No Professional Advice

Nothing in WatchMo constitutes professional sports analysis, betting advice, or financial guidance.

9. Limitation of Liability

To the fullest extent permitted by law, WatchMo and its officers, directors, employees, and agents shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or goodwill
• Service interruption or computer damage
• Any damages exceeding the amount you paid us (which is $0 for a free app)

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above may not apply to you.

10. Indemnification

You agree to defend, indemnify, and hold harmless WatchMo from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit to the App

11. Third-Party Services

WatchMo may contain links to or integrate with third-party services, including:

• ESPN (sports data)
• Social media platforms (sharing)
• App stores (Apple App Store, Google Play)

We are not responsible for the content, policies, or practices of third-party services. Your use of such services is subject to their respective terms and conditions.

12. Modifications to Service

We reserve the right to:

• Modify or discontinue any feature of the App
• Change these Terms at any time
• Update the App with or without notice

Continued use of WatchMo after changes constitutes acceptance of the modified Terms.

13. Termination

We may terminate or suspend your access to WatchMo immediately, without prior notice, if you:

• Breach these Terms
• Engage in fraudulent or illegal activity
• Harass other users
• Attempt to manipulate the App or its data

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that should survive termination will remain in effect.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Utah, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of WatchMo shall be resolved in the courts located in Utah, and you consent to the jurisdiction of such courts.

15. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us through the App's feedback feature. We will try to resolve disputes within 30 days.

If informal resolution fails, any legal action must be filed within one (1) year of the event giving rise to the claim.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and WatchMo regarding the use of the App and supersede any prior agreements.
